In a case against a municipality where a motorcyclist traveling on a local road at night. Town's practice was to close road after 11:00 pm for thru traffic by placing a chain across the middle of the intersection with an orange construction barrel in the middle. On the construction barrel was a sign stating, "ROAD CLOSED after 11:00 pm". This was done at each intersecting street for it's entire length from one end to the other. On this particular evening the sign at the beginning of the street was not in place when the motorcyclist entered it. When he road through the next intersection which was unlit there was a barrel with no sign and the chain which was not visible was lying across the roadway. As the motorcycle passed over the chain it bounced up, grabbing the front left foot peg essentially pulling the bike out from under the rider. The rider had a pre-existing back condition, however, it was proven that this accident both exacerbated that condition and created new severe injuries to his back requiring surgery consisting of several discectomies. The matter settled on the eve of trial for $650,000.00.

In a matter involving a motorcyclist traveling on his way home after work a car decided to make an abrupt left turn in front of the rider and having no alternative but to dump the bike while veering to his left to avoid disaster, another vehicle behind that car making the left was attempting to pass on the right actually striking the rider as he was sliding on the ground. The rider suffered a fractured orbital and left arm each of which required surgery. The full policy of $300,000.00 was offered by the car making the left turn and we are currently in suit against the vehicle going around the right of that vehicle.

A motorcyclist was traveling with a passenger when he came upon a van moving very slowly in front of him. As the rider began to pass the van on the left the van veered into his lane striking him on his right knee causing his knee to blow out resulting in surgery fusing the upper and lower portion of his leg. The rider was sued by his passenger and at the deposition of the police officer responding at the scene he testified that the rider said he was looking down adjusting his chin strap when the accident occurred. The rider was unable to find an attorney to take the case for two reasons, 1) the rider rear-ended the van and 2) the testimony of the police officer. We took the case and recovered just shy of the full policy in a settlement before trial.

In a matter where a car pulled out in front of a motorcycle causing the rider to lose control and go down without any contact to the car. The rider sustained a broken arm and the full policy was offered by the offending vehicle who's license plate number was taken down by a witness.

A delivery van in Manhattan which was attempting to make a U-turn caused the motorcyclist to hit the rear of the van. The motorcyclist sustained a torn ligament in his knee requiring arthroscopic surgery. The case was settled on the eve of trial for $150,000.00.

Where a driver of an SUV was rear ended by a young driver who was drag racing at such a high rate of speed so as to send the SUV over on its side across the median. Miraculously, the driver of the SUV whom we represented sustained only a laceration to his forearm and a bulging disc. We were able to recover the full policy of the driver that hit him which was lower than that of our drivers and we were able to recover an additional $30,000.00 from our driver's SUM (Supplemental Underinsured Motorist) coverage.

Where a passenger was injured in a motorcycle accident with an automobile sustaining a fractured orbital with no loss of vision a settlement of $49,000.00 was obtained.
