Motorcycle Accidents and Head Injuries

Even though I believe that people should be given a helmet choice, the state of New York mandates the use of a helmet. You may not like to wear a lid — but it's the law. Statistics show that more head injuries and more severe injuries occur to riders who are not wearing helmets, even in a low-speed crash.

According to the CDC (Center for Disease Control), a non-helmeted rider is twice as likely to have a minor head injury and five times as likely to have a severe or critical injury.

When you come to BIKR LAW, I won't lecture you on whether or not you were wearing a helmet. I will simply try to get you the most amount of financial compensation for your injuries. However, if able, always tell EMS or police that you were wearing a helmet if you were, because often times when they arrive on the scene you will have taken your helmet off and that is what they see and report. If you sustain a head injury and it is reported that you were not wearing a helmet, that report will be used by insurance companies as a defense to your claim.

Medical Care for Head, Brain and Eye Injuries

I know from experience that many of my biker clients are hard-working people. Some cannot afford to take the necessary time off from work. Most bikers, even those involved in a motorcycle accident with a serious head or brain injury, are anxious to get back on their bike. If you have a head injury from a motorcycle accident, seek immediate medical treatment at a hospital's emergency room.

Failure to seek medical care can not only damage your healing, but can also damage your legal case.

Many people have medical coverage through work, which may or may not be good health insurance. If I am your motorcycle attorney, here's what I'd like to see:

  • Get two opinions if surgery is recommended.
  • Take as much time off as possible so you can heal.
  • Don't wait to see if your headache goes away. It could prove deadly.

Compensation for Brain Injury, Eye Injury, Traumatic Brain Injury (TBI)

There are a number of ways to collect the maximum amount for your head injury. How much you recover depends more on insurance coverage than it does on the severity of the injury. No-fault medical coverage is not available for motorcycles in New York. We'll consider these factors:

  • Were you working while you were injured?
  • Do you have coverage for an uninsured or underinsured driver?
  • If the other driver was uninsured, can we take a lien against his or her property to cover your medical costs?
